GUARDIANSHIP/ INTERVENTION ORDERS (ADULTS WITH INCAPACITY SCOTLAND ACT 2000)
As life expectancy is increasing, more people are faced with looking after the interests (both financial and welfare) of their loved ones and relatives. In order to manage the finances or make decisions regarding the welfare of someone who is unable to manage their own affairs – through age, injury or an illness, anyone claiming an interest in property, financial affairs or personal welfare may apply to the Sheriff Court for an Order appointing an individual as guardian. In a great deal of cases where both financial and welfare powers are sought, Legal Aid can be made available. RGM have a great deal of experience in this area of law.
